UAE's Strict Penalties for Cinema Photography
The United Arab Emirates (UAE) has implemented severe penalties, including fines up to Dh100,000 and imprisonment for up to two months, for individuals caught taking photos or videos in cinemas without permission. Despite warnings issued before movie screenings, some movie-goers continue to violate copyright laws, prompting the government to reinforce regulations.
In 2021, the UAE government introduced Federal Law No. 38 of 2021, focusing on Copyright & Neighboring Rights, which took effect in January 2022, replacing the previous Federal Law No. 7 of 2002. Alexander Kukuev, Managing Partner at Uppercase Legal Advisory, emphasized the illegality of filming or photographing a movie scene without consent, considering it a copyright violation.
Articles 39, 40, and 41 of the new law outline penalties for copyright infringement, encompassing fines, imprisonment, and the confiscation and destruction of infringing copies. Offenders may face penalties for actions such as reproducing, distributing, or communicating copyrighted works without permission from the copyright owner.
Kukuev highlighted Article 30 of the law, stating that offenders in the UAE could be subjected to fines of up to Dh100,000 and/or imprisonment for up to two months for filming or photographing inside a cinema without the necessary permissions. The stringent measures aim to uphold intellectual property rights and discourage copyright violations within the country.
Furthermore, the UAE's copyright legislation aligns with international agreements and treaties, including the Berne Convention for the Protection of Literary and Artistic Works, of which the UAE became a member in 2004. The government's commitment to these international agreements strengthens the legal framework against copyright infringement.
To maintain cinema etiquette and adhere to age restrictions, UAE cinemas strictly enforce age ratings. Movie theaters require customers to provide proof of age and identification documents for age verification. Although there is no legal liability for underage individuals or their parents, the key consequence remains the denial of access to films with age restrictions in cinemas.
The implementation of strict measures underscores the UAE's dedication to protecting intellectual property and fostering respect for copyright laws in various entertainment sectors. Movie-goers are urged to comply with these regulations to avoid legal repercussions, as the government remains committed to upholding copyright standards and maintaining a robust legal framework in the country.
