In a recent development, a new law in the UAE emphasizes that employers cannot make decisions about hiring, terminating, or restricting job opportunities for residents based on mental health conditions. The law, which went into effect recently, requires any decision regarding employment to be based on a report from a specialized medical committee that evaluates the individual's condition in relation to their job. Similar to decisions based on physical health, hiring or firing decisions related to mental health must adhere to the same standards. This law encourages individuals to prioritize their mental well-being without the fear of losing their jobs.

Last month, the UAE issued a federal law on mental health that safeguards patients' right to retain their jobs without any restrictions. This aspect of the law aims to create an environment where individuals feel secure seeking help without fearing repercussions at work. The law is seen as a step toward a more compassionate and understanding workplace, recognizing that mental health challenges shouldn't hinder someone's professional journey, according to Dr. Hind Alrustamani, CEO and founder of Aman Lil Afia Clinic.

Dr. Alrustamani highlighted the significance of allowing employees to take sick leaves for mental well-being, stating that mental health challenges can affect performance at work in the same way physical health issues can. Having policies that allow people to take time off for mental well-being is essential, indicating that mental health is as important as physical health, contributing to a more supportive workplace.

The law regulates the relationship between patients and parties dealing with them, including caregivers, employers, and educational facilities. Violating the law can result in fines ranging from Dh50,000 to Dh200,000. Recognizing mental health as a state of psychological and social stability, the law acknowledges the multifaceted nature of mental well-being, establishing it as a foundation for productivity and contribution to society.

The law ensures clear and comprehensive rights within mental health facilities, safeguarding patients' civil rights during treatment. It prohibits limitations on employment without proper medical evaluation, prioritizes patient confidentiality and privacy, and promotes holistic recovery and reintegration into society.

Dr. Alrustamani emphasized the need for psychological care to be an essential part of insurance schemes for all. The costs of mental health services in the UAE vary, with public or government-run facilities often being more affordable than private ones. The law aims to reduce the stigma around mental health support, encouraging open discussions and continued care and support after treatment.

In conclusion, the new law in the UAE marks a significant step toward recognizing and prioritizing mental health in the workplace.
