UAE announces midday break from June 15 to September 15; up to Dh50,000 fine for violators

The UAE authorities have announced the implementation of the midday break policy for the 20th consecutive year, effective from June 15 to September 15, 2024. This policy mandates a halt to work under direct sunlight and in open-air areas across the UAE between 12.30pm and 3.00pm daily, aiming to protect the health and safety of workers during the hottest part of the day.

Companies found violating this rule will face a fine of Dh5,000 per employee working during the prohibited hours, with penalties reaching up to Dh50,000 if multiple employees are involved. The Ministry of Human Resources and Emiratisation (MoHRE) emphasized the importance of this policy in safeguarding workers, considered the most valuable resource in any company.

However, there are exceptions to this rule. Certain essential jobs related to water and electricity supply, traffic control, roadworks such as laying asphalt or pouring concrete, and other critical services are permitted to continue operations during the midday break. Employers must apply for permits to carry out these exempted tasks.

In addition to halting work during the specified hours, employers are also required to take measures to protect their workers from the sun's harmful effects. This includes providing parasols, shaded areas, fans, and sufficient drinking water at job sites, along with first aid equipment. These provisions aim to ensure workers are adequately hydrated and have access to medical assistance if needed.

“Implementing the Midday Break has become a deeply ingrained culture in the UAE’s business community and among private-sector companies in the country, given its role in ensuring the health and safety of workers,” said Mohsin Al Nassi, Assistant Undersecretary for Inspection Affairs at MoHRE.

To ensure compliance with the midday break policy, MoHRE will launch awareness campaigns and conduct field visits to work sites. These initiatives are designed to educate employers and employees about the importance of the policy and to enforce adherence.

The UAE's midday break policy reflects a commitment to worker welfare, recognizing the severe impact of extreme heat on health and productivity. By enforcing these regulations and supporting companies in compliance efforts, the UAE continues to set a standard for worker protection and occupational health and safety in the region.
