Can employer deduct employee’s salary for extending annual leave due to emergency?
In the UAE, employees returning late from annual leave without a valid reason may face salary deductions, per Article 34 of Federal Decree Law No. 33 of 2021. However, if both employer and employee agree, leave may be carried forward, as per Article 29(5) of the UAE Employment Law. Yet, the law doesn't explicitly address adjustments for additional leave taken immediately after approved leave expires. This leaves room for ambiguity regarding salary deductions. It's crucial for employers to clarify policies in writing to avoid misunderstandings. Employees can seek guidance from the Ministry of Human Resources and Emiratisation or legal advisors for resolution.
