The Laws Enacted for Companies That Offer Their Products and Services over the Telephone

While reviewing the fourth quarter progress reports on the enhancement of telemarketing regulation for products and services in the UAE, the UAE Ministry of Economy was following Cabinet Resolutions No. 56 of 2024 on telemarketing regulations and No. 57 of 2024 which is on the administrative penalties for breaches of Cabinet Resolution No. 56 of 2024.
In another press conference addressed to the media today, Director in charge of Governance Sector at the Ministry of Economy, Safiya Hashim Al-Safi, shared with the press the procedures that companies that market their products and services over the phone must observe. It was noted that the resolutions provide rules on the companies marketing their products and services telephonically within the UAE jurisdiction.
The ministry categorized firms engaging in telemarketing with the following regulations:
Secure a booking from the relevant body before commencing telemarketing campaigns.
Educate the company’s sales personnel on ethics in making marketing calls to potential customers including the practices of preserving a “Do Not Call Register” (DNCR).
Place calls using local numbers from authorized telecommunication service providers in the United Arab Emirates with such numbers recorded under a trading license of the said licensed company in the UAE.
Create a way of communication with consumers who opt-in to receive marketing information and limit outbound calling soliciting business to these consumers only.
Do not make them calls to consumers who are on the list called the “Do Not Call Register” attempting to sell them any god or services through telemarketing.
Some authorities require the telephone marketing departments to record all marketing calls so that there are proper records maintained on the documented wire marketing. Such records documentary may be destroyed upon elapsing the time frame set by the authority for the retention of such records.
Understand the restrictions relating to the recording of marketing calls and state the purpose for which the recording will be used at the beginning of the marketing call.
While undertaking telemarketing activities, a telemarketer must at least in the minimum respect ethical considerations, in case there is a such a professional code of ethics, upon the model prepared by the relevant authority, if at all such a code is issued.
Make such marketing phone calls at specified and approved times only between 9 am and 6 pm.
These callers ought to explain to the consumers the company they represent and the reason for the marketing communication at the commencement of the call.
State on the source of consumers phone numbers and phone numbers when required by regulatory authorities.
The personnel are not allowed to market by use of unapproved, restricted and/or non-registered telephone numbers.
