UAE: New employment law allows ADGM firms to hire remote workers from April 1
New rules on jobs in Abu Dhabi allows companies to deploy workers from home and to work more hours. The Registration Authority (RA) of Abu Dhabi – international financial centre ADGM, announced the laws "to give clarity to employers and employees" about their rights and responsibilities.
One of the changes is changing the definition of what constitutes an ‘employee’ so it permits remote, part-time employment. These new rules are only for ADGM-regulated companies. An employee who works from home might be in or out of the UAE but work in his/her habitual place of work is not the employer’s premises in the ADGM.
The rules take effect on 1 April "allowing employers adequate time to prepare their internal policies, employment contracts and other employment related matters in accordance with the requirements".
Now the new law says — the employer will furnish the workers and provide them with the technical means to work from home. It needs to be mentioned in the job contract that the worker is remote.
Employers need to get, keep and pay for the work permits, residence visas and ID cards for all workers, even remote workers.
Work contract for part-time workers that provides for fewer than eight working hours per day, fewer than five working days per week, or any conditions "which would otherwise be not full time working according to the employer’s ordinary procedures".
